Ok, IF you reach a amicable settlement with the builder and get your
engine back HIS warrantee will probably be contingent on you following
his recommended break-in procedures. THAT INCLUDES the oil types to be
used during that process. There is a Good chance that his services
included hardened exhaust valve seats, that alone suggests you can use
modern earls in your motor.  ASK HIM!!, he knows what was done to your 
motor and what it will take for it to survive in service.

Modern gaskets should also be up to retaining synthetic earls.
That used to mainly a problem if an old motor was switched over to
synthetic from dino earl with old gaskets that are by now mostly
hardened and might allow a little leakage.
