You should be entitled to the lesser of two amounts: (1) cost of repair; or (2) diminution of value. If the cost of repair exceeds the value of the car (which in your case it sounds like it does) you should receive the value of the car less its salvage value (this is diminution in value). By the way as a bargaining tool you can also claim loss of use. This would include such things as car rental expenses for the time it takes to have the car replaced or repaired. Frequently, even if a car is not rented you can use this to get a few extra dollars. Best of luck.
